Terms of Service
These Terms of Service ("Terms") govern your use of the aury mobile application and related services (together, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms.
1. Who we are
The Service is operated by Alina Maria Rüb, an individual operating aury as a sole developer based in Germany ("aury", "we", "us", "our"). A postal address is available on request to [email protected] and will be added here once aury is incorporated as a legal entity.

2. Eligibility
- You must be at least 18 years old to use the Service.
- You must have the legal capacity to enter into a binding contract.
- You must not be barred from using the Service under the laws of your country of residence, and you must not have been previously removed from the Service.
3. Your account
- You may hold only one account at a time and must use your real identity.
- You are responsible for keeping your sign-in credentials and device secure. Notify us promptly if you suspect unauthorized access.
- You may delete your account at any time inside the app (My Profile → Delete my account).
4. Acceptable use & Community Guidelines
Our Community Guidelines are incorporated into these Terms by reference. By using the Service, you agree to follow them. Violations may result in content removal, warnings, suspension or permanent termination of your account, as described in the Guidelines.
In addition to the Guidelines, you agree not to:
- use the Service for any illegal, fraudulent or harmful purpose;
- impersonate any person or misrepresent your affiliation with anyone;
- scrape, copy, reverse engineer or otherwise extract data from the Service except as permitted by law;
- interfere with the Service's operation, integrity or security, or attempt to bypass any access controls;
- use the Service to send unsolicited commercial communications, advertise products or services, or recruit users to other platforms;
- build a competing product using data obtained from the Service.
5. Content you post
You retain all rights to the photos, messages and profile content you submit ("Your Content"). You confirm that you have the right to share Your Content and that it does not infringe anyone else's rights.
To operate the Service we need a limited licence to host and display Your Content. You grant aury a worldwide, non-exclusive, royalty-free licence to store, reproduce, adapt (for technical reasons such as resizing) and display Your Content solely for the purpose of providing and improving the Service. This licence ends when you delete Your Content or your account, except where (a) copies may persist briefly in encrypted backups (see Privacy Policy section 5), or (b) recipients have already received Your Content (e.g. messages on their device).
We do not sell Your Content, and we do not use it to train third-party machine-learning models.
6. Reporting, moderation & transparency
You can report content or behavior that violates these Terms or the Community Guidelines from inside the app — open the person's profile and tap the flag icon in the top-left corner — or by emailing [email protected].
We review reports and may, at our discretion, remove content, warn users, suspend or permanently terminate accounts. We aim to act proportionately and to notify you of significant actions taken against your account, together with information about how to appeal, in line with our obligations under the EU Digital Services Act where applicable.
To appeal a decision, reply to the notice you received or email [email protected].
7. Suspension & termination
We may suspend or terminate your account, with or without notice, if you breach these Terms or the Community Guidelines, if we are required to do so by law, or if continued access would create a serious risk to other users or to the Service. Where possible, we will tell you why.
You may stop using the Service at any time and delete your account inside the app. The provisions of these Terms that by their nature should survive termination (e.g. sections on content licence for already-shared messages, liability, and governing law) will continue to apply.
8. The Service is provided "as is"
aury is an early-stage service operated by a sole developer. We provide it on a best-effort basis. To the extent permitted by law, we do not warrant that the Service will be uninterrupted, error-free, secure against all threats, or that it will produce specific matching outcomes. We may change, suspend or discontinue features at any time.
aury does not conduct background checks on users. We are not responsible for the conduct of any user, on or off the Service. You are solely responsible for your interactions with other users. Please use the safety guidance in our Community Guidelines.
9. Liability
Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer-protection law.
Subject to the paragraph above, and to the maximum extent permitted by law:
- aury is liable without limitation for intent and gross negligence;
- for slight negligence, aury is liable only for breach of a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible at all and on whose observance you regularly rely), and such liability is limited to the foreseeable damage typical for this type of contract;
- any other liability for slight negligence is excluded.
The Service is free of charge; aury's aggregate liability arising out of or relating to the Service is therefore limited to the foreseeable damage typical for a free consumer service of this kind.
10. Changes to these Terms
We may update these Terms as the Service evolves. If we make a material change we will notify you in the app and update the "Effective date" above. Material changes take effect no earlier than 30 days after notification, unless a shorter period is required by law. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to a change, you may delete your account before it takes effect.
11. Governing law & jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in the EU, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence.
Disputes arising out of or in connection with these Terms shall be submitted to the competent courts of Berlin, Germany, unless mandatory consumer-protection law provides for a different jurisdiction.
12. EU online dispute resolution
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
